Yesterday, Lake County Judge Eugene Lucci heard testimony in the Rock House Gym case. You’ll remember that Lucci issued a preliminary injunction on May 20 against Acton et.al. calling the rules that closed the gyms involved in the suit impermissibly arbitrary, unreasonable, and oppressive.
ODH sent one person to testify before Lucci, the local health director. During the hearing there was a line of questioning around “is it safe?”….for example:
Q-- on 5/19 was it safe to come out of lockout? A--yes.
Q--On 5/18, was it safe? A-- no. Q--Why not? A--because the Governor said so.
Lucci asked the director if there was any other reason it wasn’t safe (besides Governor saying so) and the health commissioner said no.
I expect Lucci will build on his preliminary injunction and we will soon have a permanent injunction against Acton, et. al.
Whether the state will appeal the decision remains to be seen. Cases are opening on a daily basis—yesterday a group of restaurants filed suite in Lake Co.
In Lorain County, Gerald Phillips filed an election contest suit citing 90+ election law & constitutional violations.
Amusement parks filed suit last week.
With the latest information from the WHO revealing asymptomatic spread is very rare, the fabric of the masks, mandates and punitive recourse by the state is fast falling apart.
