Look, I have always tried to be a straight shooter, even when it makes people in various places angry. I gotta give you fool-proof truth or I cannot sleep at night
Well, this post is a little different but intended to inform you of several ‘inside baseball’ items that people want to know. So, I am going to try and cover them but this is long because a lot is going on and needs explanation. This gets in the weeds, grab some coffee and let’s roll.
First, the lawsuit.
We had a HUGE day yesterday in Lake County where a judge ruled Acton’s numerous orders are harming and unconstitutional. (See yesterday’s post.)
Second, what did the Senate really do yesterday with SB 55 and SB1?
Well, for one, the senate “informally passed” SB 55. This bill would have reduced Acton’s penalties and fines from $750 and us getting a record if we violated her often incomprehensible orders, to getting a free pass on the first ‘offense’ of her orders, then $150 per incident and no permanent record. I personally would have liked to see a $1 fine, but I am one of 99 and passing bills takes compromise.
Passing something ‘informally’ is an inside baseball term which basically means taking a punt. It means the Senate did not want to vote on it. The bill is not dead, but they refused to vote. Why would the Ohio Senate NOT want to at least reduce the fine and eliminate any criminal record? WOW. I was extremely disappointed they did not take a vote. Those who know me know I like public votes and I am personally not afraid to go on record and show the people how I stand. The Senate basically said, we are okay with you being fined and getting a permanent criminal record based on Acton’s orders. I am not and the House was not which is why the Ohio House passed and sent the Senate SB55 to reduce penalties.
Third, SB 1.
This is the bill that basically would have reined Acton in and made any order only good for 14 days unless JCARR which is a group of Democrats and Republicans, would have to vote to extend it. It would have given legislative control over these orders. The House passed this 2 weeks ago and the Senate did NOTHING about this bill for 2 weeks. Just sat on it.
The Senate had three options. Vote it into law, vote it down, or vote to send it to conference committee. They chose the latter. What that means is the House and the Senate now have 3-4 people from each chamber who get in a room and hammer out what each chamber does not like about the bill from the other chamber and come to an agreement. I will be honest, both chambers are fighting over legal issues and precise language in the bill. This happens often when both chambers do not agree on exactly the same language. Who’s right? That honestly will be decided by a lot of lawyers and hopefully quickly.
That said, my advice to ‘we the people’ would be to politely, keep the pressure on both the House and the Senate to PASS SB1. My take is as follows. We have a major crisis on our hands. It is a constitutional crisis, crisis of our economy and a crisis of severe government overreach. We have a crisis of people NOT getting the health care they deserve and a crisis of businesses being denied their right to open, to run their business as they see fit and a crisis for people to honorably earn a paycheck and feed their families. ANYONE getting in the way of someone being able to put in an honest day’s work for an honest day’s pay really angers me.
That said, this legal war going on between the House and Senate on SB1 needs to be resolved and resolved quickly. My message to all my colleagues and the people of Ohio is simply to GET IT DONE. Put your pride, your desire for power and your desire for the next election aside and think ONLY of your fellow citizens of Ohio. Hammer out these differences in what is known as the ‘conference committee’ and pass SB1 and SB 55. Be Nice. Be Firm. Get ‘er done House and Senate. Our livelihoods are at stake.
‘We the people’ do not want an oligarchy, we don’t want a dictatorship, we want to Restore the Republic! We want our freedom. And WE want to be in charge of our safety.
I personally want government so small you can barely see it.
Fourth, SB 311.
You have likely heard a lot about this new bill and other new bills. They are not bad bills and they have great sponsors, but the truth is, I am MOST concerned about three big things; our school year, our fall election, and someone trying to shut down the economy again. We already had our schools closed and our election turned into a hot mess and crushed the best economy ever. It can all happen again if left to only one health director. The truth about these new bills is that they have to go through at least 3 senate committees, then pass the senate main chamber, then go through at least 3 House committees and pass the main House chamber. Then it takes 90 days for the law to go into effect. If you add all that up, we could be into November or December or maybe even next year before these ‘new’ bills become law. The school year is already toast, the election is over and our jobs are lost forever. We cannot take another hit like this. It must stop.
SB 55 and SB 1 have already gone through the legislative process. They just need to have the Senate pass them and by mid-August, these orders will be law. Our school year and election and economy will ‘have the counsel of many’ by allowing ELECTED Republicans and Democrats a vote on these orders or they expire.
Lastly, the veto and emergency clause.
First, the emergency clause in a bill allows a law to ‘skip’ the 90 day waiting period and become law as soon as the bill is signed by the governor OR as soon as the bill is passed in both chambers with a veto override. Getting an emergency clause passed is much harder than a veto override. SB 311 has an emergency clause, but the Senate does not have the votes to pass the emergency clause. It takes 60 to override a governor’s veto in the House and 67 to pass an emergency clause. The emergency clause just does not have the votes in either chamber, so we are left with the 90 days.
What about overriding the Governor’s Veto? As you know, the governor can veto the bill, but the House and Senate can override. I think there is a good chance that BOTH CHAMBERS with the pressure of WE THE PEOPLE, can indeed override a veto. But we have to take things one step at a time. SB1 needs to pass out of conference committee and SB 55 needs to simply be brought up for a vote in the Senate and passed into law.
Is a long-term solution needed to revise these 100-year-old health laws? I say maybe. Because if you look up Article 2 Section 1D of the Ohio Constitution on emergencies, it ALREADY SAYS 2/3rds of a vote is needed by the House and Senate. I say FOLLOW THE LAW which is not being followed now. We will get into that another day but most certainly, clarification is needed so orders are not dictated by one health director in Ohio.
For now, we need SB 55 and SB1 to be passed so they can go into effect around mid-August. Please focus your efforts there.
